4. How We Store and Protect Your Data

We do not sell your personal data to advertisers or third parties.

Lumi uses minimal cookies necessary for the service to function, including session authentication cookies. We do not use advertising or tracking cookies. You may disable cookies in your browser settings, though some features of the service may not function correctly as a result.

1. Acceptance of Terms

By accessing or using Lumi (the "Service") at trydraftd.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Lumi, operated by Martin Mathew.

2. Description of Service

Lumi is an AI-powered voice journaling and content idea generation service that allows users to record voice journal entries, receive AI-generated content idea frameworks, and build a personalised Creator Profile. The Service is currently in early access (waitlist stage) and features may change before public launch.

3. Eligibility

You must be at least 13 years old to use Lumi. If you are between 13 and 18 years of age, you must have the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements.

4. Your Account

When you create an account or join the waitlist, you agree to:

• Provide accurate and complete information
• Keep your login credentials secure and confidential
• Notify us promptly of any unauthorised access to your account
• Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Your Content

You retain full ownership of all voice journal recordings, transcriptions, and any other content you create using Lumi ("Your Content"). By using the Service, you grant Lumi a limited, non-exclusive, worldwide licence to process Your Content solely for the purpose of providing the Service to you (including transcription, analysis, and generation of content ideas).

We do not claim ownership of Your Content. We will not use Your Content for any purpose other than providing the Service, and we will not share it with third parties except as described in our Privacy Policy.

6. Acceptable Use

You agree not to use Lumi to:

• Violate any applicable laws or regulations
• Submit content that is illegal, harmful, threatening, abusive, defamatory, or obscene
• Infringe the intellectual property rights of others
• Attempt to gain unauthorised access to the Service or its systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools to scrape, crawl, or extract data from the Service
• Resell or redistribute the Service without our written permission
• Impersonate any person or entity

7. AI-Generated Content

Lumi uses artificial intelligence to generate content idea frameworks based on your voice journal entries. You acknowledge that:

• AI-generated content ideas are suggestions only and may not always be accurate, appropriate, or suitable for your purposes
• You are solely responsible for reviewing, editing, and publishing any content you create using Lumi's frameworks
• Lumi does not guarantee that AI-generated content ideas are original or free from third-party intellectual property claims
• You should exercise your own judgement before publishing any content

8. Intellectual Property

The Service, including its design, software, features, and technology, is owned by Lumi and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service or its components without our express written permission. The Lumi name, logo, and mascot are trademarks of Lumi.

9. Pricing and Payments

Lumi offers a free tier and paid subscription plans. Pricing is displayed within the Service. Paid plans are billed on a monthly basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with reasonable notice to existing subscribers.

During the early access period, the first 100 waitlist members receive the Creator plan free for 3 months upon public launch, as stated on our website.

10. Service Availability

We aim to keep Lumi available at all times, but we do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience resulting from Service downtime.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO LUMI IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

13. Termination

You may stop using the Service and close your account at any time by contacting us at draftdapp@gmail.com. We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately.

14. Changes to These Terms
